By creating an account, downloading, or using the Ourclave application or services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services.
These Terms are a legal agreement between you ("you," "your") and Ourclave, Inc. ("Ourclave," "we," "us," "our"), a Delaware corporation.
You must be at least 13 years old to use Ourclave. If you are between 13 and 18, you must have the consent of a parent or legal guardian. By using the Services, you represent that you meet these requirements.
Ourclave Family plans may include profiles for minors over 13, managed by a parent or guardian account holder. The account holder is responsible for all activity under their Family plan.
To use the Services, you must create an account with a valid email address and password.

Important: Your password is used to derive the encryption key for your data. We do not store your password and cannot recover it. If you lose your password, your encrypted data is unrecoverable. This is a fundamental aspect of our privacy architecture.

Ourclave is not a healthcare provider, medical device, or clinical tool.
The Services provide general wellness information and personal data analytics. Nothing in the Services constitutes medical advice, diagnosis, treatment, or prescription. The Services are not intended to replace professional medical judgment.
You should:
N=1 Experiments: The N=1 experiment feature helps you observe personal correlations in your wellness data. Experiment results reflect statistical patterns in your personal data — they are not clinical trials, and the results are not medically validated. Correlation does not imply causation.
AI Assistant: The AI assistant provides general information and helps organize your health data. It is not a medical professional and may produce inaccurate or incomplete responses. Always verify health-related information with a qualified source.

Prices are subject to change with 30 days' notice. Changes do not affect your current billing period.
The Free plan is provided at no cost and may have feature limitations. We reserve the right to modify Free plan features with 30 days' notice. We will not require payment for features that were free when you created your account without your consent.
You own your data. Ourclave does not claim any ownership rights over your health data, notes, documents, experiment results, or any other content you create or import into the Services.
You grant us a limited license to store and transmit your encrypted data solely for the purpose of providing the Services (e.g., syncing across your devices). Because your data is encrypted with a key we do not possess, this license is functionally limited to storing and transmitting encrypted blobs we cannot read.
You may export your data from Ourclave at any time in standard formats. We will provide reasonable export tools to facilitate this. Your data is yours, and you should never be locked in.
You may delete your data at any time. See our Privacy Policy for details on data retention and deletion.
Ourclave offers an optional "Contribute to Science" feature that allows you to share privacy-protected experiment results with the Ourclave community. This feature is entirely voluntary. If you choose to participate:
(a) Differential Privacy Protection. Your contribution is processed using differential privacy, a mathematical technique that adds calibrated statistical noise to your data before it is shared. This means your individual results cannot be determined from the shared data — by anyone, including Ourclave.
(b) Voluntary and Per-Experiment. You choose whether to contribute each experiment's results individually, at the conclusion of each experiment. You are never required to contribute. Non-participation does not affect your access to any Ourclave features or services, and no experiment results are contributed without your affirmative, per-experiment consent.
(c) What Is Shared. A noise-protected version of: the experiment's effect size (how much the intervention appeared to help or not), the intervention category (e.g., "sleep supplement"), and the experiment duration. What is NOT shared: your raw health data, your identity, specific dates, device information, or any data that could identify you.
(d) Revocation. You may revoke any contribution at any time through Settings > Privacy > My Contributions. Revocation removes your contribution from future aggregation. Because differential privacy aggregation is a one-way mathematical process, previously computed Community Insights that incorporated your contribution cannot be retroactively disaggregated — but your contribution will not be included in any future computations.
(e) Community Insights. Aggregated Community Insights derived from contributions are made available to all Ourclave users. Ourclave may reference Community Insights in aggregate form in marketing materials, research publications, or public communications. No individual's contribution is identifiable in any published insight.
(f) No Sale of Contributions. Ourclave does not sell, license, or share individual contributions with third parties. Only aggregated Community Insights — which by mathematical construction contain no individual-level data — may be referenced externally.
(g) Eligibility. The Contribute to Science feature is available only to users aged 18 or older. Child profiles and users under 18 are not eligible to make contributions.
(h) Separate Consent. Your consent to contribute is separate from your agreement to these Terms of Service. Agreeing to these Terms does not enroll you in contributions. Each contribution requires a separate, affirmative action on your part.
Ourclave allows you to connect third-party data sources (e.g., Strava, Oura, Withings) via OAuth. When you connect a service:

The Services, including the software, design, architecture, documentation, and trademarks, are owned by Ourclave, Inc. and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Services as described herein.
Certain components of the Services use open-source software. Those components are licensed under their respective open-source licenses, which can be found in the application under Settings > Open Source Licenses. Nothing in these Terms restricts your rights under those open-source licenses.
If you provide feedback, suggestions, or ideas about the Services, you grant us a non-exclusive, perpetual, irrevocable, royalty-free license to use that feedback for any purpose without compensation or attribution. You are not required to provide feedback.
Your privacy is fundamental to our product. Our handling of your data is described in our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes our architecture-specific approach to data protection, including encryption, sandboxing, and zero-knowledge sync.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Without limiting the foregoing, we do not warrant that:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OURCLAVE, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO OURCLAVE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
IMPORTANT: Because your data is encrypted with a key derived from your password that we do not store, we cannot recover your data if you lose your password. You acknowledge and accept this risk as inherent to our privacy architecture.
You agree to indemnify and hold harmless Ourclave, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:
Before filing a formal dispute, you agree to contact us at legal@ourclave.com and attempt to resolve the issue informally within 30 days.
Any dispute that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted in Delaware or remotely at your election.
Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in a class action, class arbitration, or representative action.
The following are exempt from the arbitration requirement:
You may opt out of the arbitration provision by sending written notice to legal@ourclave.com within 30 days of creating your account. If you opt out, disputes will be resolved in the state or federal courts located in Delaware.
You may terminate your account at any time by deleting your account through the app or contacting us. Upon termination:
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. We will provide notice unless prohibited by law or if the violation poses an immediate threat to the Services or other users.
If we terminate your account without cause, you are entitled to a pro-rated refund for any pre-paid subscription period.
Sections 5 (Wellness Disclaimer), 7.1 (Data Ownership), 10 (Intellectual Property), 12 (Disclaimers), 13 (Limitation of Liability), 14 (Indemnification), and 15 (Dispute Resolution) survive termination.
Governing Law. These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles.
Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Ourclave regarding the Services.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
Waiver. Our failure to enforce any provision of these Terms is not a waiver of that provision.
Assignment. You may not assign these Terms. We may assign these Terms in connection with a merger, acquisition, or sale of assets, provided the assignee agrees to be bound by these Terms.
Notices. We may send notices to the email address associated with your account. You may send notices to legal@ourclave.com.
Force Majeure. We are not liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authority, fire, floods, epidemics, or internet infrastructure failures.
